Mediation is a form of alternative dispute resolution (ADR).  It is a flexible and confidential process in which a trained neutral actively assists the parties to achieve a negotiated agreement of a dispute, with the parties in ultimate control of the decision to settle and its terms.

One of the key benefits of mediation is that it is significantly quicker and cheaper than litigation and some other forms of ADR including arbitration.  It provides a flexible mechanism to facilitate a solution to allow you to move on and save face.  As a result, it is often less stressful and draining on a party’s human and other resources than other proceedings.

The process is entirely confidential.  Mediation is “without prejudice” which prevents statements made in a genuine attempt to settle the dispute from being put before the court as evidence of admissions against the party which made them.  Any agreement reached to settle the dispute has the same effect as a binding court ruling.

We can advise you on the options for resolving a dispute through means other than litigation. We can help you resolve the dispute through a specialist accredited mediator.  We can also coordinate the practical arrangements for the mediation day, whether at our central London office or a neutral venue.
